Representation of Minor or Disabled Individuals

Individuals under a disability due to age, injury, or illness require attention that may not be needed in the general population. The need for guardianship or conservatorship forprotection of assets is a goal of Andy’s representation. Preservation of government benefits may sometimes be accomplished without disturbing other assets of the disabled individual. The means to accomplish those ends require specialized attention.

The law presumes person to be competent and this is true even where an individual suffers from a serious permanent disability from birth or during their minority.  Parents of such children only have legal authority until the disabled child attains age 18 and thereafter a guardian must be appointed.  Recent changes in the Court Rules relating to guardianships of both minors and disabled individuals mean that you need someone with experience if the practice is to navigate these issues.
